Delhi High Court: Alimony for Genuine Need Only

The Delhi High Court has ruled that individuals who are financially independent cannot be granted permanent alimony, highlighting that alimony aims to address social justice rather than serve as a means of enrichment or financial balance between capable parties. Justices Anil Kshetarpal and Harish Vaidyanathan Shankar of the Division Bench stated that those seeking alimony must prove a genuine need for financial support.

The court’s decision was made in the context of a case where a family court had denied permanent alimony to a woman while granting a divorce to her husband on grounds of cruelty. The couple, who had previous divorces, separated within 14 months of their marriage. The husband, a practicing lawyer, accused the wife, a Group A Indian Railway Traffic Service (IRTS) officer, of mental and physical cruelty, including verbal abuse, denial of rights, and professional and social humiliation. The wife refuted these allegations and counter-accused him of cruelty.

The family court, in its ruling, noted that the wife had demanded a financial settlement of Rs 50 lakh for agreeing to the divorce—a claim she confessed to in her affidavit and during questioning. The High Court upheld this decision, stating that the wife’s approach had financial implications, as evidenced by her demands.

Furthermore, the court highlighted that the wife’s use of derogatory language towards her husband and his mother, including questioning his legitimacy, constituted mental cruelty. Given the woman’s senior government officer status and substantial income, the High Court declined to award permanent alimony, citing the short duration of the marriage, absence of children, her financial independence, and lack of evidence of financial need.

This ruling follows a trend of increased scrutiny of high-value alimony claims in India. In a recent case, a woman’s petition for a house in Mumbai, Rs 12 crore as maintenance, and a luxury BMW led Chief Justice of India BR Gavai to comment on her qualifications and earning capacity.

The judgment signifies the court’s stance on alimony in cases where one party is financially self-sufficient, emphasizing the importance of genuine financial need in determining alimony awards.
